The debate over Lothar Ebke's arrest continues in a Yellowknife
courtroom. Yesterday, a crown prosecutor told the judge the man's
arrest did not violate the Canadian constitution. The 47-year old
Yellowknife man is wanted by German authorities on suspicion of being
involved in terrorist activities. Ebke's lawyer, Wes Wilson, argues
Ebke hasn't been charged with anything, and so the arrest violates his
constitutional rights. But crown prosecutor Wes Smart told the court Wilson
is taking the language used in the arrest warrant too literally. "The
Germans have said they've issued a warrant for the arrest, and its
evident on its face that's what it's called and it's for the
purpose of prosecution," he said. Wilson has asked the court to stay
the extradition proceedings against Ebke on constitutional grounds. Smart
says Ebke's rights have not been violated...and the court shouldn't
interfere in a German prosecution.
